Measuring Personal Injury Damages
For personal injury cases, BVI will use the reports produced by other experts such as vocational rehabilitation plans and life care plans to develop a projection of losses. Losses in personal injury cases can include lost wages and other employment benefits, business interruption damages, lost household services, and the cost of continuing medical care. BVI will develop a model of the damages specific to the injured party, determine cost growth factors and a discount rate, and compute the present value of the damages. The methods used to analyze damages caused by a wrongful death are similar to those used to model personal injury damages, but often include additional factors to be computed, such as loss of childcare services.
For personal injury and wrongful death cases, we will primarily work with the reports produced by vocational rehabilitation experts. However, if the injured party is a business owner, we will likely request the types of documents that are needed in commercial damages cases.
